In Georgia, child support is determined through a worksheet that takes into account both parents’ incomes (See O.C.G.A. § 19-6-15). The parties will thus either agree on – or ask the court to decide – the gross annual income of the parents. The parties will then input this data into the worksheet to calculate their monthly payments.
The child support worksheet calculations are based on a number of factors, including but not limited to:
- The gross income of both parents
- Self-employment taxes
- Health insurance programs
- Actual income or income earning potential (based on education, work history and experience)
Georgia law also provides for several deviations/adjustments to the calculations to account for the specific circumstances of a case.
Eleven deviations for child support are outlined in Georgia law and can be used to modify the amount of child support to be paid. They are:
- High income
- Low income
- Health related insurance
- Child and dependent care tax credit
- Travel expense related to visitation
- Alimony
- Mortgage
- Permanency plan or foster care plan
- Extraordinary expenses
- Pre-existing child support orders
- Whether either parent is supporting another child
- Extracurricular activities of the child(ren)
- Child care expenses of the child(ren)
- Parenting time
- Nonspecific deviations – Which are required to have a detailed explanation
Once the specific circumstances of the case have been factored in and the deviations have been calculated, the court will decide on the final amount to be paid. It is important to note that each person who fills out a child support worksheet could get different numbers, as they may have their own opinions of deviations, etc.
If the party assigned to pay child support does not follow the court orders, they may be found in contempt of court, which could lead to serious fines or even imprisonment. A child support modification form can be filed every two years if the circumstances of that party have changed.
